QUICKOFFICE PRIVACY POLICY
This Privacy Policy explains what information Quickoffice, Inc. ("Quickoffice" or "we") collects from individuals ("you") who visit the Quickoffice.com website ("Quickoffice.com" or the "Site") or who use software licensed by Quickoffice (the "Software"). This Privacy Policy also explains how Quickoffice uses and maintains that information. By using the Site, and any content or links included in the Site, you are accepting the terms of this Privacy Policy, including Quickoffice's rights to use your personal information, in each case as stated below.
Additional terms, if applicable, regarding the specific privacy rules associated with certain Software applications or services, or regarding any Site activity (such as a contest or sweepstake), will be set forth in the end user license agreement associated with that Software or the terms of participation associated with that activity, as applicable.
This Privacy Policy (the "Policy") may be modified at any time and from time to time by Quickoffice. The current version of this Policy can always be found under the Privacy button on the Site. You can tell if there have been changes to this Policy by checking the "Last Updated" and "Effective" dates at the top of the Policy page.
1. Types of Information Collected
We collect two kinds of information ("Information") through the Site or in connection with your activation and use of our Software. The first kind is Information that can identify you as a specific individual - such as your name and email address ("PII"). We only collect PII if:
- you decide to register on the Site
- when you license or download Software through the Site,
- when you participate in any Site activities, such as contests, or contribute to any Site forum or bulletin board; or
- when you communicate with us through the Site, through other social media or through the Software.
The second kind of Information is the kind of non-personally identifiable information ("NPII") collected and stored automatically by many websites. It includes, for example, information about your Internet service provider, operating system, type of browser, geographic location, and pages viewed on Quickoffice. Although this information is related to you, it is not associated with your PII and cannot be linked to you personally.
2. Collection of PII
Quickoffice collects PII in the following ways:
- If you purchase Quickoffice software through the Site, you will be asked to provide certain PII to allow us to process the transaction. Quickoffice does not store your PII except for credit card type, expiration date, and the last four digits of the credit card number.
- When you activate your Quickoffice software, you will be asked to provide certain PII so that we can activate your account, validate your license and qualify you to receive user support.
- When you notify us of a problem with the operation of the Site or the Quickoffice software, or when you submit a suggestion, complaint, question, request, or any other e-mail correspondence, Quickoffice asks for your e-mail address so that you can receive a response. This information will only be used to notify you of receipt of your submission and to address your comments or concerns.
We do not intend to collect PII from anyone we know to be under 16 years of age. If you are under 16, you should not be submitting any PII. By providing us with your PII, you are representing that you are over 18 and you are authorizing our use and disclosure of your PII as described in this Policy and any subsequent revisions to this Policy that we may publish on the Site.
3. Use of PII
Quickoffice may use your PII to notify you of upgrades to our Software, as well as to let you know about new services, products and other offers you may find valuable. You can opt out of these emails by following the "unsubscribe" instructions in any email.
If you participate in any Site activities (such as contests or forums), your PII may be shared, disclosed or used in other ways, including when we announce contest winners and award prizes. The rules provided by Quickoffice for the activities in which you choose to participate will inform you about these other uses of your PII.
Quickoffice may provide your PII to third parties who process financial transactions you initiate through the Site or the Quickoffice Software or who work with Quickoffice to provide you with Software support. Those third parties are bound by contract to protect your PII against unauthorized disclosure.
If Quickoffice, or all or a portion of its business, is acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, or similar event, your PII may be transferred to the third party as a result of that event.
And of course, Quickoffice reserves the right to disclose PII as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial or regulatory proceeding, court order, legal process, government request, or in similar circumstances.
4. Collection of NPII
As is the case with many websites, we gather certain information automatically and store it in log files. This anonymous technical and statistical information is collected whenever you visit our Site and when you activate our Software through cookies, beacons, tokens, or similar technologies. We use this information to customize your experience on Quickoffice.com and to help us improve the quality of the Site and our Software. This information may include your IP (Internet protocol) address, Internet service provider, operating system, type of browser, geographic location, and pages viewed on Quickoffice.com.
5. Site Content and Materials; Disclaimer of Warranty.
The Site is intended to provide you with useful information about Quickoffice's product and service offerings. It also may offer you the ability to download materials that relate to those offerings or to other matters which Quickoffice believes may be of interest to you (collectively, "Materials"). While Quickoffice uses reasonable efforts to ensure the accuracy of the Site content and Materials, you understand that such content and any such Materials are provided "AS IS." To be clear, Quickoffice expressly disclaims any and all warranties and representations with respect to such content and Materials, including implied warranties of accuracy, completeness or currency.
6. Proprietary Rights
The Site content and Materials are the property of Quickoffice or third parties and are protected by U.S. and foreign laws protecting intellectual property rights, including those protecting copyrights and trademark. This Policy authorizes you to use and copy the Site content and Materials, but only for your personal, non-commercial use and subject to the terms of use associated with any such Materials. You may not distribute or publish Materials or Site content without the prior written consent of Quickoffice. Any copies you may make of Site content or Materials should include all proprietary notices and marks contained in the original.
The trademarks, logos, and service marks (whether or not registered, collectively the "Trademarks") displayed on the Site or in Materials are Trademarks of Quickoffice and/or third parties. You have no right to use the Trademarks in any way and nothing contained on the Site should be construed as granting to you, by implication, estoppel or otherwise, any license or right to use any Trademark without Quickoffice's written permission or the written permission of the third party that owns the Trademark.
7. Security
We have implemented technical, administrative and physical security measures to protect Information from unauthorized access and improper use. We keep Information on servers that are protected by firewalls and which we maintain or which are maintained by third parties under contract with us. All Information is encrypted when stored and when transmitted from our site. From time to time, we review our security procedures in order to consider appropriate new technology and methods. Please be aware though, that, despite our reasonable efforts, no security measures are impenetrable and any connection to Quickoffice or information transmitted to us or to Quickoffice will be at your own risk.
8. Monitoring and Indemnification
Quickoffice does not undertake and has no obligation to monitor Site activities or your submissions of PII. But, in addition to the rights reserved above with respect to our use of PII and NPII, we reserve the right to (a) use Information to protect our company, employees, Site, or other Site users or visitors, and (b) share Information with governmental authorities, including judicial, regulatory and enforcement authorities.
You agree to indemnify and hold harmless Quickoffice, its officers, directors, employers, licensors and business partners, and any other party providing services in connection with the Site or any Quickoffice software or services, from any and all damages, claims or liabilities arising out of content or Information you provide to or through the Site.
9. Links from the Site and Software
Quickoffice provides links to the websites, services and software of certain third parties. If you link to any of these third party Web sites, services or software, this Policy will not apply to your use of those sites, services and software. We encourage you to read the legal notices posted on these sites, including their privacy policies. Quickoffice shall have no responsibility or liability for your experience with, and the data collection and use practices of such third party sites and software. All inquiries concerning the use of PII by a third party should be communicated to that third party. In addition, Quickoffice makes no representation as to the quality, performance or content of any such third party sites, services or software. You understand and acknowledge that any access or use that you make of the same is at your own risk and Quickoffice has no responsibility or liability for damages or other costs, expenses or claims, of any kind and based on any theory of law or equity, including negligence, arising out of such access or use.
10. Copyright Protection
If you believe that any content on this Site violates your or a third party's copyright, you should contact Quickoffice immediately by email to policies@quickoffice.com. For your notice to be effective, it needs to include the following:
a) your electronic or physical signature;
b) sufficient information to identify the copyrighted work that you claim has been infringed;
c) a description of the infringing content and the location on the Site of such infringing content;
d) your name, address, telephone number and/or email address so that we may contact you;
e) the following statement: "I have a good faith belief that use of the copyrighted material described above is not authorized by the copyright or trademark owner, its agent or the law"; and
f) the following statement: "I swear, under penalty of perjury, that the above information in this notification is accurate and that I am, or am authorized to act on behalf of, the owner of the exclusive right that is allegedly infringed."
If Quickoffice receives a valid counter notification complying with the provisions of Section 512(g) of the U.S. Copyright Act to the effect that the allegedly infringing content was removed as a result of mistake or misidentification, the content may be reinstated.
11. Limitation on Liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW, IN NO EVENT AND UNDER NO LEGAL OR EQUITABLE THEORY, INCLUDING NEGLIGENCE, SHALL QUICKOFFICE, ITS OFFICERS, EMPLOYEES, DIRECTORS, LICENSORS, OR ANY OTHER PARTY INVOLVED IN SUPPORTING THE SITE OR QUICKOFFICE SOFTWARE OR SERVICES, BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR REVENUES, COSTS OF REPLACEMENT GOODS, LOSS OR DAMAGE TO DATA, SOFTWARE OR EQUIPMENT, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR RELIANCE ON THE SITE AND/OR QUICKOFFICE SOFTWARE OR SERVICES, EVEN IF SUCH DAMAGES WERE FORESEEABLE BY QUICKOFFICE. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE PRECEDING LIMITATION MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT ALLOWED BE LAW, ALL CONTENT, SOFTWARE, AND ACTIVITIES PROVIDED ON THIS SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. QUICKOFFICE EXPRESSLY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING, WITHOUT LIMITATION, THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THOSE ARISING FROM A COURSE OF DEALING OR USAGE, OR TRADE.
General
This Agreement constitutes the entire agreement between you and Quickoffice with respect to your use and access to the Site and can only be modified by Quickoffice as first referenced above.
If any portion of this Agreement is deemed void or unenforceable, then that provision shall be deemed severable from the Agreement and the remaining terms shall remain in full force and effect.
This Agreement is governed by and shall be construed in accordance with the laws of the State of Texas. By accessing or using the Site, Site content or the Materials, you are agreeing to submit all disputes or claims you may have with respect to the Site, Site content or Materials to federal or state courts located in Collin County, Texas, and you hereby agree to the personal jurisdiction of such courts and waive all objections to venue therein.
